Terms of Service

1. Acceptance of Terms

By accessing or using AskBob ("the Service"), operated by DataToday NV ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

AskBob is a multi-tenant SaaS platform providing AI-powered recruitment matching, CV parsing, template editing, and ATS integration services for recruitment agencies and HR departments.

3. Account Registration

You must provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes intellectual property rights
• Attempt to gain unauthorized access to other accounts or systems
• Use the Service to discriminate against candidates based on protected characteristics
• Reverse engineer, decompile, or disassemble the Service
• Exceed rate limits or abuse API endpoints
• Resell or redistribute the Service without authorization

5. Data Ownership

You retain ownership of all data you upload to or create within AskBob ("Your Data"). You grant us a limited license to process Your Data solely to provide the Service. We will not access, use, or share Your Data for any purpose other than operating the Service and as described in our Privacy Policy.

6. Subscription and Payment

Subscriptions are billed monthly or annually, in advance. Prices are in Euros (EUR) unless otherwise stated. All fees are non-refundable except as required by applicable law or as specified in our refund policy below.

Refund Policy

• Annual subscriptions: Full refund within 14 days of purchase
• Monthly subscriptions: No refund for the current billing period
• You may cancel at any time; access continues until the end of the billing period

7. Service Level Agreement

For paid plans, we commit to 99.9% monthly uptime. Details of measurement and remedy procedures are provided to customers on paid plans on request to hello@askbob.be.

8. Intellectual Property

The Service, including its software, design, logos, and documentation, is owned by DataToday NV and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service.

9. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR. A Data Processing Agreement is available for all customers.

10. Limitation of Liability

To the maximum extent permitted by law, DataToday NV shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you to us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DataToday NV from and against any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Termination

Either party may terminate the subscription with 30 days written notice. We may suspend or terminate your access immediately for material breach of these Terms. Upon termination, you may export your data within 30 days, after which it will be deleted.

13. Governing Law

These Terms are governed by the laws of Belgium. Any disputes shall be resolved by the courts of Antwerp, Belgium.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance.
